The service text spells out, in so many words, what is included in the first history: „einschließlich homöopathischer Repertorisation und Gewichtung der charakteristischen psychischen, allgemeinen und lokalen Zeichen und Symptome des jeweiligen Krankheitsfalls, unter Berücksichtigung der Modalitäten, Alternanzen, Kausal- und Begleitsymptome, zur Auffindung des homöopathischen Einzelmittels, einschließlich Anwendung und Auswertung standardisierter Fragebogen“ — including homeopathic repertorisation and weighing the characteristic psychological, general and local signs and symptoms of the particular case, taking into account the modalities, alternations, causal and accompanying symptoms, to find the homeopathic single remedy, including the use and evaluation of standardised questionnaires. That is part of the service itself, not a separate additional service.
„Mit schriftlicher Aufzeichnung“ — with a written record — stands in the service text itself, not only in a provision about documentation: the written record is therefore part of the service Number 30, not only its later administration. The purpose is named in the wording: „zur Einleitung einer homöopathischen Behandlung“ — to begin a course of homeopathic treatment.
What the service text does not describe is the follow-up history or a later continuation of the treatment — the schedule carries a number of its own for that, Number 31, which appears here only inside the quoted provision. The multiplier for Number 30
Number 30 stands in Abschnitt B, so it falls within the ordinary fee range: from the single rate up to the 3.5-fold rate, with the 2.3-fold rate as the span within which, under § 5 Abs. 2 Satz 4 GOÄ, a fee is as a rule assessed.
For this number, § 5 Abs. 2 Satz 3 GOÄ is the sentence a justification runs up against: criteria for assessment already accounted for in the service description are left out of consideration. That the history-taking carries a minimum duration and proceeds with a written record stands in the service text itself — it is already reflected in the point count, and does not by itself carry an increase.
Above the 2.3-fold rate, § 12 Abs. 3 GOÄ applies: written, tied to the particular service, comprehensible and traceable for the person liable to pay, and to be explained further on request.
What the record has to carry for Number 30
The service text names a minimum duration, and § 12 Abs. 2 Nr. 2 GOÄ expressly requires the invoice to state „einschließlich einer in der Leistungsbeschreibung gegebenenfalls genannten Mindestdauer“ — including any minimum duration named in the service description. An invoice can only carry that statement if the duration was recorded during the history-taking.
Because the service is billable only once within one year, the record carries the date of the preceding first history. For a child where the history-taking fell short of the full minimum duration, the provision requires a corresponding justification — that too belongs in the record, not only on the invoice.
The written record is not an additional duty here alongside § 630f BGB, but part of the service itself. § 630f BGB requires the essential measures and their results in immediate temporal connection with the treatment in any case; for Number 30, this record is the very subject of the service that the invoice reflects.
